Introduction

Welcome to SubTrackR. These Terms of Service ("Terms") govern your use of the SubTrackR mobile application ("App") operated by SubTrackR Inc. ("we," "us," or "our").

By downloading, installing, or using our App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our App.

User Accounts

Account Creation

To use certain features of the App, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

Account Deletion

You may request to delete your account at any time through the App's settings. Upon account deletion, we will remove your personal information in accordance with our Privacy Policy, though we may retain certain information as required by law.

Subscription Tracking Service

Purpose

SubTrackR provides tools to help you track and manage your third-party subscriptions. We do not directly manage, control, or modify any third-party subscriptions you track in our App.

Accuracy of Information

We strive to provide accurate information, but we do not guarantee the accuracy, completeness, or reliability of any content or data within the App. You are responsible for verifying all subscription information with the respective service providers.

No Financial Advice

The App provides informational and organizational tools only. It does not provide financial advice, and you should not rely on the App for financial planning or decisions.

Subscription Plans

Free Plan

The basic version of the App is available free of charge and provides limited features, including tracking up to 5 subscriptions.

Premium Plans

We offer premium subscription plans with additional features:

• Monthly Plan: $2.99 per month

• Annual Plan: $12.99 per year (save 64%)

• Lifetime Plan: $29.99 one-time payment

Payment and Billing

All payments are processed through the Apple App Store. Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage your subscriptions through your App Store account settings.

Refund Policy

All purchases are final and non-refundable, except as required by applicable law. Any refund requests must be submitted to Apple according to their refund policy.

Intellectual Property

App License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices that you own or control.

Ownership

The App, including all content, features, and functionality, is and will remain our exclusive property. The App is protected by copyright, trademark, and other intellectual property laws. You agree not to copy, modify, create derivative works, reverse engineer, decompile, or otherwise attempt to extract the source code of the App.

User Content

By submitting, posting, or displaying content on or through the App ("User Content"), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content for the purpose of providing and improving the App.

User Conduct

You agree not to:

• Use the App in any way that violates any applicable law or regulation

• Use the App for any illegal or unauthorized purpose

• Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the App

• Upload or transmit viruses, malware, or other malicious code

• Collect or track the personal information of others

• Impersonate any person or entity

Third-Party Services and Links

The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You agree that we shall not be responsible or liable for any damage or loss caused by your use of such websites or services.

Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

IN NO EVENT WILL WE, OUR AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Indemnification

You agree to defend, indemnify, and hold harmless us, our affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the federal or state courts located in San Francisco, California.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
